Stuart Wagstaff Addresses Memorial Goers After Death – Can you Leave Funeral Instructions in Your Will?

Stuart Wagstaff, who passed away peacefully at Castlecrag Private Hospital in Sydney aged 90, earlier this month, addressed those attending his memorial from beyond the grave.

In a posthumous email, addressed to his closest friend, family and colleauges, the former entertainer and navy man informed attendees of his memorial service on Tuesday:

 "Just to let you know that I have 'shuffled off this mortal coil' and I'd like to thank everyone who has shared with me all the ups and downs of these fascinating 90 years.There won't be a funeral as I have donated my tired old body to the anatomy department of the University of Sydney. (Hey! I finally got to Uni!!). Thanks and farewell."

The memorial service itself was held at the Theatre Royal, a place where Wagstaff had performed on numerous occasions and delighted many audiences.

This raises interesting questions for those who have specific plans or instrcutions for their funeral or memorial service regarding whether they can leave instructions in their Will and whether these must be honoured under the law.

Can you include funeral instructions in your Will?

It is possible, and not uncommon to leave funeral or memorial intructions in your Will. The only issue with this is that under the law, carrying out these instructions is not compulsory. Furthermore, often your Will will not be looked at until after your funeral has taken place.

However, if you do have specific instructions for your funeral you should ensure that your executor and close family members are aware of these instructions. It may also be helpful to discuss anything that may be ambiguous with the plans with your solicitor and executor to ensure your wishes are properly interpreted.
