We recently wrote about a significant case that had reached the High Court (“Who’s the Daddy”? Sperm Donor’s Parental Dispute Reaches the High Court). This case has been widely reported and, on the 19 June 2019, the High Court delivered its decision.
The donor’s lawyers argued that under Commonwealth law the man should be recognised as a parent because he is the biological father and involved in the child’s life, The High Court agreed, concluding that the man who had donated his sperm to his lesbian friend, is the father.
The significance of this landmark decision has been recognised overseas too. In the UK, the decision has been widely reported. The Daily Telegraph commented:
“A sperm donor in Australia has won a landmark high court battle to confirm his parental rights and stop the mother taking the child to live in New Zealand.”
