A team of solicitors working for the estate of the deceased billionaire Michael Wright have challenged a decision to award a $25m inheritance to his teenage daughter.
The challenge comes after the Supreme Court of Western Australia ruled that the estate had to pay Wright’s 19-year-old daughter $25 million up front in place of a trust fund that was set up by her father. This would be the largest payout regarding an estate in Australia.
The Will of the mining tycoon had been challenged by his daughter after she had felt her father had failed to make reasonable provisions for his life. Her bid for a greater share of Wright’s $2.7bn fortune was opposed by Wright’s estate and his two elder daughters from an earlier marriage. The appeal was launched by the executor of the estate.
There are a number of steps to protect your Will, however, one of the most common reasons for a Will being challenged is failure to talk to beneficiaries and those involved in the Will. As a result the final Will can come as a shock and rash challenges to Wills can be made. Wills can frequently be challenged as they are not clear, or there may be multiple documents. As a result it is imperative to enlist the help and guidance of a solicitor who can ensure that your final wishes are carried out.
