Society recommends against homemade Wills

The Law Society of New South Wales recently held a series of events to highlight the dangers associated with homemade Wills.

A properly written Will is essential as it is the best way for you to ensure that your assets are distributed in accordance with your wishes after your death. It also allows you to ensure your wealth is passed on to the next generation in the most efficient way, and at the same time minimises the risk of legal disputes arising over the distribution of your estate.

It is therefore important that you not only have a Will but also that you have this prepared by a qualified legal professional, who will be able to ensure that your Will is properly drafted and fully reflects your needs and wishes.

According to President of the Law Society of NSW, John Dobson, many people underestimate the complexity of their affairs and believe that making a Will is something they can easily do themselves. However, he advises against this and instead recommends that people always seek legal advice when preparing Wills or estate plans.

"Dying without a Will in place or having a badly prepared one can cause major stress and expense for those left behind, and is an all too common cause of serious rifts between amongst family members," he explained.

"Opting for an apparently 'cost-effective' do-it-yourself Will can result in delay, uncertainty and substantial legal costs to the Will-maker's family and estate as well," he added.
